PART 2 — CLIENT SERVICES FRAMEWORK

Status of this part. This is a framework of topics Stoke Marketing’s signed client agreements should address, with protective statements that are common in digital marketing. It is not itself a binding contract. No prices, refund terms, cancellation periods, payment terms or liability caps appear, because none are verified.

  1. Services overview. Stoke Marketing offers marketing strategy, branding and design, web design, digital advertising, photography and videography, local search and SEO, and AEO/AI visibility services. Scope, deliverables, timeline and fees for each engagement are set out in a signed proposal, statement of work or agreement (a “Client Agreement”). If a Client Agreement conflicts with this page, the Client Agreement controls.
  2. Proposals and agreements. Services begin only after a Client Agreement is signed or electronically accepted and any required deposit is received.
  3. Client responsibilities. Clients agree to provide timely access, accurate information, feedback and approvals; to have the right to use everything they supply (text, logos, images, music, testimonials); and to keep their own accounts and logins secure. Delays in client input may delay delivery.
  4. Client materials and permissions. Clients grant Stoke Marketing a license to use client-provided materials to perform the services. Clients are responsible for releases and consents (including from people appearing in photos or video) for materials they supply, and for the legality of their own advertising and communications.
  5. Intellectual property and deliverables. Typically Stoke keeps its pre-existing tools, templates and know-how, and third-party assets (stock images, fonts, plugins, themes) stay under their own licenses and may need separate fees or renewals.
  6. Website design and development. Scope and revision rounds are defined in the Client Agreement. Websites depend on third-party themes, plugins, hosting and domains with their own licenses, updates and security needs. Unless the Client Agreement says Stoke provides hosting, maintenance, backups or security monitoring, the client is responsible for them. Browser, device and plugin changes after launch may affect appearance or function.
  7. Branding and creative approvals. Creative work moves through stages the client approves in writing (email counts). Approved work is considered accepted for that stage, and changes after approval may be additional scope. Stoke does not clear logos or names for trademark availability; clients should consult an attorney for that.
  8. Photography and videography. The Client Agreement should define usage rights (where, how long, which media), who owns raw files, and whether Stoke may use the work in its portfolio. Clients are responsible for location permissions and for releases from identifiable people unless Stoke agrees in writing to obtain them.
  9. SEO and AEO. Search and AI-answer results are determined by third parties (such as Google and AI platforms) using factors outside Stoke’s control, including algorithm changes, competitor activity and site history. Stoke Marketing does not guarantee any ranking, position, traffic, visibility in AI-generated answers, or lead volume.
  1. Digital advertising. Ad platforms (Google, Meta, streaming networks and others) set and may change their own policies, approvals, pricing and auction rules, and may reject ads or suspend accounts. Clients remain responsible for the truthfulness and legality of their offers and claims. Ad spend is separate from Stoke’s fees and requires the client’s written budget approval. Stoke does not guarantee impressions, clicks, leads, sales or return on ad spend.
    1. Analytics and reporting. Reports rely on data from third-party platforms and tracking tools. Data may be incomplete or inaccurate because of consent settings, ad blockers, processing delays, bots, attribution models and other factors. Stoke is not responsible for errors originating in third-party data.
    2. Lead generation. Lead quality and conversion depend on the client’s offer, pricing, sales process, response times, seasonality and market conditions, which Stoke does not control.
    3. Third-party platforms. Clients agree to follow the terms of every platform used in the engagement. Third-party fees, subscriptions and renewals are the client’s responsibility unless the Client Agreement says otherwise.
    4. Confidentiality and data protection. Each party will protect the other’s non-public business information and use it only for the engagement. Where Stoke handles clients’ customer or patient data, the Client Agreement should address data-protection duties, security expectations and breach notice.
    5. Entire agreement; changes. The Client Agreement and its attachments are the whole agreement for the engagement. Changes must be in writing.
